Conditions of Entry

  1. Information on how to enter and prizes form part of these Conditions of Entry. Participating in this promotion is deemed acceptance of these Conditions of Entry.
  2. For the purposes of this promotion, the following definitions will apply: “Entrant” means any Australian resident aged 18 years or over that submits a valid completed online entry in accordance with these Terms and Conditions; and “Voter” means any Australian resident aged 18 years or over who registers to vote on entries that appear on the promotional website, which shall include Entrants.
  3. Entry and voting is only open to Australian residents aged 18 years or over.
  4. Employees of the Promoter and its agencies associated with this promotion and the immediate family of these people are ineligible.
  5. Entrants must go to www.sm33.com.au, complete the online entry form, upload a photo using the form and submit all requested details. Photos must be of children aged between 6 months and 3 years. Each Entrant warrants that: (a) they are the person who took the photograph submitted with the entry; (b) that they are the parent or legal guardian of the child featured in the picture; and (c) that the child featured was between 6 months and 3 years old at the time the photograph was taken and submitted. Winners may be requested to sign a statutory declaration to this effect.
  6. The Promoter reserves the right, at anytime during or after the closing date of the promotion, to verify the validity of entries or votes and Entrants and Voters (including their identity, age and place of residence) and to disqualify any Entrant or Voter who tampers with the entry or voting process or who submits an entry or vote that is not in accordance with these Conditions of Entry. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  7. Multiple entries permitted, subject to the following: (a) only one entry permitted per round; (b) each entry must be substantially unique and (c) each entry must be submitted separately and in accordance with entry requirements. Entrants must supply contact details including email address to participate.
  8. Incomplete or indecipherable entries will be deemed invalid.
  9. Promotion commences 14/09/2008. Entries close 5pm AEST on 07/12/2008. Voting closes at 5.00pm AEST on 14/12/2008. The winners will be notified by mail, email and all winners will be published on www.sm33.com.au. The Promoter’s decision is final and no correspondence will be entered into.
  10. There will be 6 Rounds of voting prior to the determination of the major prize winner. Entries for each Round close at 5pm AEST on the following dates: Round 1 –28/09/2008; Round 2 –12/10/2008; Round 3 –26/10/2008; Round 4 – 09/11/2008; Round 5 –23/11/2008 and Round 6 – 07/12/2008. A winner from each Round will be determined via an online vote. During each Round, Voters can vote upon all entries that have been received up to that Round’s close date. Voters will have the opportunity to award one (1) vote for each displayed entry during the promotional period. A Voter may only submit one vote per entry (including any entry submitted by the Voter themselves). All votes will be tallied by the Promoter in order to determine the winners. The entry with the highest number of votes at the conclusion of each Round (ie. 6 in total) will each win a $250 AUD Toys R Us gift voucher and will be showcased on the promotional website as a winner for that Round. Once an entrant has been determined a winner in a Round, their winning entry will no longer be eligible for subsequent rounds, but will be entered into the Final Round. Only winners in the first 6 Rounds will be eligible for the Final Round. All non-winning entries in each round will roll over to subsequent rounds except the Final Round. All accumulated votes from a previous Round will be discarded and all entries in each Round will commence each Round with no votes. In the event of a tie between entries, the tied entries will be judged and the winning entry will be determined by the Promoter in its absolute discretion and based on the creative merit and originality of the photo.
  11. Entries in the Final Round will be judged based on the creative merit and originality of the photo. The best valid entry, as determined by the Promoter, will win a $1000 Osh Kosh B’Gosh voucher. This is a game of skill and chance plays no part in determining the winner.
  12. The Promoter shall not be liable for any gift voucher that has been lost, stolen, forged, damaged or tampered with in any way.
  13. Redemption of the gift voucher is subject to the terms and conditions specified on the gift voucher. Any ancillary costs associated with redeeming the gift voucher are not included. Any unused balance of the gift voucher will not be awarded as cash.
  14. The Promoter will use reasonable endeavours to ensure the photographs and images are not downloaded by third parties without authorisation, however, if such an event occurs, the Promoter accepts no responsibility.
  15. The Promoter reserves the right to request winners to provide proof of identity and residency at the nominated prize delivery address as well as the age of the child photographed. Identification considered suitable for verification is at the discretion of the Promoter.
  16. Total prize pool value is $2500. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  17. All photographs submitted become the property of the Promoter. As a condition of entering into this promotion, each Entrant agrees to irrevocably assign all of their rights, title and interest (including copyright) in and to their photographs to the Promoter. Each Entrant warrants to the Promoter that each photograph submitted is an original artistic work of the Entrant, which does not infringe the rights of any third party. The Entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoter is entitled to use any of the Entrants’ photographs for any purposes at its discretion, including using the photographs for future promotional, marketing and publicity purposes without any further reference or remuneration.
  18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  19. Any costs associated with accessing the promotional website is the Entrant’s or Voter’s responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
  20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
  21. All entries remain the property of the Promoter. The Promoter collects Entrants’ and Voter’s personal information in order to conduct the promotion. If the information requested is not provided, the Entrant or Voter may not participate in the promotion. By entering the promotion, unless otherwise advised, each Entrant and Voter also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant or Voter, including sending the Entrant or Voter electronic messages. As per the relevant Privacy Legislation, a request to access, update or correct any information should be directed to the Promoter at their address set out below.

Conditions of Entry

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents who are employed as a pharmacy assistant. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. To enter, pharmacy assistants must fully complete the official fax entry form found in Contact Magazine (August issue), including answering the 4 questions provided and then fax it back to (02) 9422 2788. Maximum cost of fax will not exceed 55c including GST.
  5. Incomplete, indecipherable or illegible entries will be deemed invalid.
  6. Only one entry permitted per pharmacy assistant.
  7. Promotion commences on 28/08/08. Entries close 5:00pm AEDST on 27/10/08. The draw will take place at Reed Business Information, Tower 2, 475 Victoria Ave NSW 2067 on 31/10/08 at 3:00pm AEDST. Winners will be notified by mail. The Promoter’s decision is final and no correspondence will be entered into.
  8. The first 5 valid entries drawn with all 4 questions answered correctly will each win a Coles Myer Gift Card valued at $100.
  9. Any ancillary costs associated with redeeming the Coles Myer Gift Card are not included. Any unused balance of the Coles Myer Gift Card will not be awarded as cash. Redemption of the Coles Myer Gift Card is subject to any terms and conditions of the issuer including those specified on the Coles Myer Gift Card.
  10. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  11. Total prize pool value is $500. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  12. A draw for any unclaimed prizes may take place on 02/02/09 the same time and place as the original draw. Winner, if any, will be notified by mail.
  13. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  14. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
